Terms of Service
Client
• The client must be over the age of 18 and is solely responsible for reading the Terms of Service before inquiring.
• All rights to their own work (characters, world, etc...) are retained by the client.
• The Client agrees to sign a commission contract upon payment.Artist
• The Artist retains the copyright of the artwork, as well as the right to refuse the work commissioned.
• By non-exclusive licences the Artist retains the right to sell the commission either personally or to a third party.Payment
• The commissions will be paid upfront; if the commission is higher than 500€, the payment is split 50/50 (half upfront and half upon completion, but before the watermark is removed).
• Payment is accepted only via PayPal and in Euro only.
• The invoice must be paid within 10 business days, otherwise the commission will be cancelled by the Artist.Refunds and Cancellation
• No refunds. In case the Client pays a split payment and cancels the commission, the Artist will keep the first half, as well as the artwork, and will owe the Client nothing further.
• Exception: In case the Artist is unable to complete the project, a full refund will be arranged.
• The Client is prohibited from using any of the work in progress (sketches, files, designs) personally or commercially if the commission is cancelled.Copyright
• The Artist retains the copyright to the artwork.
• A copyright transfer request can be made for 500% of the original price.
• The Artist retains the right to share the artwork/s to their social media pages and portfolio.
• A request for an agreed upon publishing date can be made to the Artist.Credit
• The Client agrees to only post the watermarked low-resolution JPG version of the final artwork to any online space.
• The Client MUST credit the artist by tagging applicable social media handles.Commercial use
• The Artist currently does not accept commercial commissions.
• The Client is prohibited from using personal commissions for commercial uses.Other
• The Client is responsible for proofing the work provided by the Artist.
• The Client agrees to hold the Artist harmless against any and all claims, costs, and expenses, including attorney fees, due to materials included in the Work Commissioned at the request of the Client for which no copyright permission or privacy release was requested. If the Client supplies the Artist with materials subject to intellectual property rights by a third-party, the Client will secure the appropriate rights to use the materials before directing the Artist to incorporate them into the project. Should any intellectual property dispute arise involving materials the Client provides, the Client assumes full legal and financial responsibility.
• The Client is responsible for obtaining licences from a third-party copyright holder of character(s)/scenes depicted in the artwork.
• Uploading, posting, or editing any commissioned artwork or licensed piece into artificial intelligence (AI) programs by the Client is STRICTLY PROHIBITED.
• The Client is restricted from putting any commissioned artwork or license piece up for sale as NFT (non-refundable token).
• At no point will the artist accept inquiries for NFT's.
